Heat Treatment
- While ASSAB prides itself in providing quality service to our Customers, it is inevitable that there would be some risks which affect the heat treatment services provided and Customer hereby accepts all risks related to the heat treatment including but not limited to the transit and delivery of Customer’s materials, loss misplacement, shortage in weight or count of the Customer’s equipment and/or materials (whichever is applicable) at our premises. Provided otherwise agreed in writing, our liabilities for all heat treatment services provided herein, shall not exceed twice the amount of our charges for the affected material (first to reimburse for the charges and second to compensate in the amount of the charges). The remedy stated herein is Customer’s sole and exclusive remedy and in no event will we be liable for any special, indirect or consequential damages.
- Warranty, whether written or oral, is expressed or implied as to the suitability of the furnace, equipment and process used for the heat treatment.
- We will not be responsible for any performance delays; or omission; or non-performance due to causes beyond our reasonable control.
- No statement or recommendation made or assistance given by us or our employees or representatives in connection with the heat treatment of the Customer’s equipment and/or material shall constitute a warranty by us.
- Our failure to exercise any of our rights as stated herein will not be deemed a waiver or forfeiture of those rights.
- Whenever any instruction is given by Customer as the manner of heat treatment for the Customer’s equipment and/or materials, we shall fulfill the instructions without being liable for any loss damage or injury whatever.
- Any grievances in respect of heat treatment work done on the Customer’s equipment and/or materials must be communicated within forty-eight (48) hours after the completion of our work or before any further processing assembling or other works carried out by the Customer on the same equipment and/or materials, whichever occurs earlier.
